Is it necessary or required by law that a claim needs to be filed for both insurance policies.

    Nope you usually only have to file with the company of the person at fault.

    You don’t have to file with either unless you’re at fault. But if you need help, your agent will be able to help.

    If you aren’t at fault, but don’t want to be compensated for your loss, just ignore it.

    Only give the information to your agent. If any one from the other insurance company tries to talk to you, tell your agent before you speak to the other insurance company.

    You should report all accidents to your insurance company. Even if you think you are not at fault, the other guy may try to pursue a claim against your policy. Your insurance company would question you as to why you did not report the loss. An early investigation into the details of the accident is critical should the other guy try to make a claim against you. Just because they make a claim does not mean your insurance company will pay anything.

    You can make a direct claim against the other person’s liability coverage if you so chose. There is no law which governs claims reporting by a third party.
